I. GENERAL PROVISIONS

  1. This privacy and cookie policy sets the rules for treatment of personal data and the use of cookies at the https://cityboard.pl/ Website (further referred to as the Website).
  2. The Controller of personal data collected through the website is the company Cityboard Media Sp. z o. o. with its registered seat in Warsaw (02-541) at Narbutta street no. 30, identified by the National Taxpayer Identification number NIP 5251003406, and National Business Registry Number REGON 011355200, entered into the National Court Register under no. KRS 0000024971 (further referred to as the Controller).

  4. Each entity using the Website is its User.
  5. Personal Data of the Website User is processed by the Controller pursuant to the provisions of the law currently in force, and in particular with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (further: the GDPR).

II. PROCESSING OF PERSONAL DATA

  1. Newsletter
    The User who wishes to register to receive the Newsletter must provide the Controller with his e-mail address, via the Newsletter registration form. Provision of this data is voluntary, but necessary in order to register for the Newsletter.
    The data provided to the Controller during the registration for the Newsletter is used to send the User the Newsletter with current news, information, commercial and marketing materials regarding the activities of Cityboard Media Sp. z o. o. The legal basis for the processing of personal data is the consent of the User (Article 6 (1) (a) of the GDPR), given at the moment of registering for the Newsletter.
    The data shall be processed for the duration of the functioning of the Newsletter, or until the User cancels his subscription of the Newsletter.
    The User may cancel the subscription of the Newsletter at any time, which shall result in the User’s personal data being removed from the Newsletter database.
    The User has the right to access his personal data, request their rectification and deletion, and also to object to the processing of his personal data. The User is also entitled to lodge a complaint to the President of the Personal Data Protection Office if he decides his personal data is processed in contravention of the law.
  2. Contact form
    The personal data of the User, sent to the Controller via the contact form, shall be processed in order to respond to the question asked. The legal basis for the processing of personal data is Article 6 (1)(f) of the GDPR, that is, legitimate interest of the Controller – communication with the Website User.
    Where the User requests the Controller to present a commercial offer, his personal data shall be processed on the basis of Article 6 (1)(b) of the GDPR, that is, provision of data by the User for the purpose of actions meant to conclude a contract.
    The personal data of the User shall be processed for the period necessary to handle any correspondence between the parties, extended by the period relevant for the relationship of the correspondence with the concluded legal relationship (e.g. a concluded contract), data storage obligations, the pursuit of any potential claims or other obligations imposed by the applicable provisions of the law.
    The User has the right to access his personal data, request their rectification and deletion, and also to object to the processing of his personal data. The User is also entitled to lodge a complaint to the President of the Personal Data Protection Office if he decides his personal data is processed in contravention of the law.
    The provision of personal data is voluntary, but necessary if the User wishes to receive a reply to the message he sent.

III. RECIPIENTS OF THE DATA

  1. The personal data of the Users may be processed by subcontractors of the Controller, that is, entities whose services the Controller uses.
  2. The Controller uses the services of only such processors who provide sufficient guarantees of implementing the appropriate technical and organizational means, so that the processing complies with requirements of the GDPR and protects the rights of the data subjects.
  3. The provision of data by the Controller does not take place in each case, and not to all recipients or their categories indicated in the privacy policy – the Controller provides the data only when this is necessary to fulfill the given purpose of personal data processing and only in the scope necessary to fulfill it.
  4. Personal data of the Users may be provided to the following recipients or their categories:
    1. service providers who supply the Controller with IT, technical and organizational solutions that enable the Controller to perform his business, including the operations of the Web page and the provision of electronic services through it (this includes in particular providers of software used to set up and maintain the Website, providers of electronic mail and hosting services, and providers of software used to manage the firm and to provide technical assistance to the Controller),
    2. providers of legal, accounting and consulting services, who provide the Controller with accounting, legal or consulting support.

IV. COOKIES

  1. The cookies are small-sized text information in the form of text files, sent by the Server and stored on the devices of Website visitors (e.g. on the hard drive of a desktop or laptop computer, or on the memory card of a smartphone – depending on what kind of device is used by the Website User).
  2. The Controller may process data contained in the Cookies during the time the User uses the Website, for the following purposes:
    1. to adapt the Website content to individual preferences of the User (e.g. with respect to the colors, font size, page layout) and to optimize the use of the Website;
    2. to keep anonymous statistics presenting the manner of Website use;
    3. remarketing, that is, analyzing the features of Website visitors through anonymous analysis of their actions (e.g. repeated visits to specific sub-pages, keywords etc.) in order to create their profile and to deliver them advertising matched to their forecast interests, also when they visit other websites in the advertising Network of Google Inc. and Facebook Ireland Ltd.;
  3. The Controller informs the User that there is an option to configure the Web browser in a manner that would prevent the storage of cookies on the User’s device. In such a situation, the User may experience difficulties when using the Website.
  4. The Controller informs that the cookies may be removed by the User after they are recorded by the Controller, through the relevant functions of the Web browser, software used for that purpose or the relevant tools available under the operating system installed on the User’s device.

V. OTHER TECHNOLOGIES

  1. Google Analytics
    The Website uses the Google Analytics tool, supplied by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Actions in that regard are carried out by the Controller on the basis of his legitimate interest (Article 6 (1)(f) of the GDPR), which involves the collection of statistical data and its analysis for the purpose of website optimization.
    Information regarding the use of the Website by the User is collected automatically by Google Analytics and stored at the Google server, located in the United States of America.
    The User’s IP address is shortened before being transferred. In some situations, the Google server in the USA receives the full IP address of the User which is shortened after receipt. The anonymized IP address sent by the User’s Web browser under Google Analytics is not combined with other Google data as a rule.
    Google LLC with seat in the USA, using technical infrastructure located in the USA, has joined the EU-US-Privacy Shield program, which guarantees the appropriate protection level for the processed personal data, and has been approved by the European Commission.
    The User may prevent the recording by Google of details collected by the cookies, regarding his use of the Website, and may also prevent the processing of this data by Google, by installing a plug-in to his Web browser, available at the following address: https://tools.google.com/dlpage/gaoptout.

  2. Google Adwords
    The Website uses marketing tools of Google AdWords, supplied by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Thanks to Google Adwords the Website is promoted in search results and at websites of third parties. The actions in this respect are carried out by the Controller for the purpose of his legitimate interest (Article 6 (1) (f) of the GDPR), namely the marketing of his own products and services
    . When the User visits the Website, Google AdWords automatically records on his device the remarketing cookies file, which enables the displaying of advertisements based on the User’s interests. Further processing occurs when the User gives Google his consent to combine the history of browsing and application usage with the User’s account and to use information from his Google account to personalize advertisements displayed at visited websites. If the User is logged onto his Google account when displaying pages of the Website, Google shall use the User data together with the Google Analytics data in order to create and define lists of target groups for remarketing purposes, on different devices. For this purpose, Google temporarily combines the User’s data with the Google Analytics data, to create target groups.
    Google LLC with seat in the USA, using technical infrastructure located in the USA, has joined the EU-US-Privacy Shield program, which guarantees the appropriate protection level for the processed personal data, and has been approved by the European Commission.
    The User may deactivate cookies used for remarketing purposes under his Google account settings. Details regarding the processing of data under the Google AdWords service are available at the website: https://policies.google.com/privacy.
  3. Google Tag Manager
    The Website uses the tool Google Tag Manager supplied by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Using the Google Tag Manager, the Controller controls the delivery of advertising campaigns and the manner in which the User uses Web pages comprising the Website. The actions of this Controller in that respect are performed based on his legitimate interest (Article 6 (1) (f) of the GDPR), involving the marketing of his own products or services and the optimization of the Website’s pages.
    When the User visits the Website, a Google cookie is automatically stored on his device, which with the use of a pseudonymized identifier (ID) and on the basis of history of visited websites allows to show the User advertisements based on his interests, to control the effectiveness of these advertisements and to undertake other actions tied to monitoring of the User’s activity at the Website.
    Google LLC with seat in the USA, using technical infrastructure located in the USA, has joined the EU-US-Privacy Shield program, which guarantees the appropriate protection level for the processed personal data, and has been approved by the European Commission.
    The User may deactivate cookies used for remarketing purposes under his Google account settings. Details regarding the processing of data under the Google Tag Manager service are available at the website: https://policies.google.com/privacy.
  4. Facebook Pixel
    The Controller uses the Facebook Pixel service, provided by Facebook Ireland Limited (4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland). The Facebook Pixel tool allows the Controller to measure the effectiveness of his advertisements and to adapt the advertisements to the given User.
    The legal basis for these action is the legitimate interest of the Controller (Article 6 (1)(f) of the GDPR). Facebook Pixel automatically collects data on the use of the Website by the User, and next transfers this data to its servers located in the European Union or in the USA and stores it there. On the basis of the collected information the Controller is not able to identify the individual User of the Website. The collected data allows only to define the actions that were performed by the User on the various websites.   5. Social media tools
    The Website uses plug-ins of the following social media: Facebook, Google, YouTube, LinkedIn, Twitter.
    The social media plug-ins are interactive elements of the Website, which enable the sparing of Website content on social media and enable to redirect the User visiting the Website to social media profiles of the Company.
    After the User clicks the given plug-in, a direct connection to the server of the given social media portal is established, and the portal may collect information and use cookies.
    If the User is logged into his account on the given social media portal, the portal may assign the User’s visit to the Website to his account on the social media. Information on the purpose of collection of data, its further processing and use by the individual social media portals, as well as on the related rights of the User and possible settings which may be used to protect User privacy are provided in the privacy policies of the individual social media.

    If the User who has an account on any of the social media portals does not want the operator of the given portal to collect his data through the Website and combine it with other recorded data, before visiting the Website he should log out of the given social media portal and, as an additional measure, also remove the relevant cookies.

VI. Server logs

The use of the Website is tied to queries sent to the server on which the Website is stored. Each query sent to the server is recorded in server logs.

The logs include such information as the IP address, server date and time, information on Web browser and operating system of the User.

The collected logs are stored for an unspecified time, as auxiliary material used to administer the Website. The information contained in the logs is not disclosed to anybody, aside from persons authorized to administer the servers and network of the company. The log files may be used to generate statistics, which help to administer and manage the site. Collective summaries in the form of such statistics do not contain any details identifying Website Users.
